DescriptionHandwritten contract detailing the assignment of mortgage to William Newton. One page, double-sided.
TranscriptKnow all men by these presents that we William B. Ogden by William E. Jones his attorney in fact, and William E. Jones of Chicago Illinois of the first part in consideration of the sum of nine hundred and thirty three 50/100 dollars to be paid by William Newton of Chenango County New York of the second part the receipt of which is acknowledged Have and by these presents Do grant bargain sell assign transfer and set over unto thee said party of the second part a certain Indenture of Mortgage leaving unto the fifth day of December A.D. 1842 made by Erastus Newton of Will County Illinois to Robert F. Bartlett of the same place, and recorded – December 1842 in XXXX Office of Will County in Book G page 510 – the same having been duly assigned to is on thee 17th day of January AD 1845 as appear & endorse – meant thereon – together with the money due and to sum due thereon with the interest. To have and to hold the XXXX to thee said party of the Second part his heirs and assigns forever subject only to the proviso in the said Indenture of Mortgage mentioned. The said party of the second part is to collect the same at his sole risk and expense and in case of payment may discharge the XXXX as fully as we might or could do if this assignment will XXXX made. Dated January 3, 1850 Sealed & delivered in presence of XXXX William B. Ogden by Wm. E. Jones his attorney, in fact Wm. E. Jones.

State of Illinois County of Cook SS – I Andrew J. Brown a Notary Public in and for the personally appeared before me William E. Jones to me personally known to be the person whose name is [submitted] to the forgoing XXXX of writing as having executed the name and administered that he truly and certainly executed the name as the attorney in fact of William B. Ogden and also as his own free account and deed for the uses and purposes therein certify in writing whereof I have hereunto set my hand and [notance] it seal this third day of January A.D. 1850 and signed Andrew J. Brown Notary Public
