TranscriptsThis Indenture made this 25th day of March 1850 between William Newton of the town of Sherburne, County of Chenango, State of New York party of the first part and Robert Milne of Lockport Will County Illinois party of the second part XXXX. That whereas Erastus Newton of Lockport aforesaid on the 21st day of April 1845 executed and delivered to the said William Newton a mortgage for the [consideration] and for the purposes therein mentioned conveying to the said William Newton certain lands situated in the town of Lockport aforesaid and of which the lands hereinafter described are part and parcel and whereas the said the Erastus Newton by his Indenture of Mortgage bearing date the fifth day of December 1842 did for the consideration and for the purposes therein mentioned convey to Robert F Bartlett (which mortgage has been duly asigned by the said Robert F Bartless Ogden and Jones and by the said Ogden and Jones asigned to the said William Newton) and of which the lands hereinafter described are part and parcel and whereas the said Erastus Newton by his Indenture of Mortgage bearing date the 24th day of December 1844 did for the consideration and for the purposes therein mentioned convey to (L) C Chamberlin and Esther R Fuller as administration and administrative of Elam Fuller deceased (which said mortgage has been duly asigned to the said William Newton) certain lands in Lockport aforesaid and of which the lands hereinafter described are part and parcel and whereas the said Erastus Newton by deed dated February 26, 1848 hath conveyed to the said Robert Milne that portion of the premises included in the said several mortgages aforesaid hereinafter described and whereas the said Robert Milne party of the second part on the day of the date hereof has paid unto the said William Newton party of the first part the sum of one dollar on the payment of which the said William Newton hath agreed to release to the said Robert Milne his heirs and against the lands hereinafter described and to take and accept the residue of the said mortgaged premises as his security for the payment of the moneys remaining unpaid on the said several mortgages aforesaid: Now therefore the said William Newton in consideration of the said premises both hereby grant and release from the lien of the said several mortgages aforesaid to the said Robert Milne and to his heirs and asigns all that part of the said mortgaged lands bounded and described as follows Twenty acres of land off the west side of the west half of the east half of the south east quarter of section twenty three township thirty six north of Range ten east with the hereditaments and [appurtenances] thereunto belonging or in any wise appertaining. To have and to hold the lands and premises hereby released to the said Robert Milne his heirs and asigns to his and their only XXXX use and behoof forever free and clear and discharged of and from the lien of the said several mortgages aforesaid. In witness whereof the said party of the first part hath hereunto set his hand and seal the day and year aforesaid. William Newton State of New York Chenango County: On this 22nd day of March in this year 1850 William Newton [to] XXXX known to be the person described XXXX and who executed the forgoing instrument personally came before me and acknowledged that he executed the same.
